OVERVIEW
Salt Water Colours, Ltd. (the “Company”) understands that privacy is important to you. This Privacy Policy (“Policy”) describes how your personal information is collected, used, and shared by the Company, as it pertains to our website (the “Site”).

PERSONAL INFORMATION WE COLLECT
When you visit our Site, certain information is automatically collected about your device, including information about your web browser, IP address, access times, time zone, and the webpage, search terms, or link that referred you to our Site. Additionally, as you browse our Site, we may collect information about the individual web pages or products that you view, and information about how you interact with our Site. We call this information “Device Information.”

We collect Device Information using the following technologies:

    – “Log files” track actions occurring on our Site, and collect data including the Site visitor’s IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.

Additionally when you make a purchase or attempt to make a purchase through our Site, we collect certain information from you which you directly provide, including your name, billing address, shipping address, payment information (including credit card numbers, email address, and phone number).  We refer to this information as “Order Information.”

Other information that we collect from you occurs when you directly provide us with information, input submissions, other contact details not provided as part of a purchase transaction, social media handles, links, opinions, requests, tips, or any other information submitted when you voluntarily choose to complete a survey, provide feedback, post messages, post reviews, email us, correspond with us, text us, or message us. Also, Other Information includes when you interact by providing such information on any of our services, be it website, social media apps, or other presences which we maintain, fill out any other types of forms, or sign-up for any offers, marketing, newsletters, or other communication not mentioned above. In general but not in a completely strict sense, information that you voluntarily provide which does not fall into the Device Information category or the Order Information category, is referred to as “Other Information.”

When we talk about “Personal Information” in this Privacy Policy, we are talking about Device Information, Order Information, and Other Information.

HOW DO WE USE YOUR PERSONAL INFORMATION?
We use your personal information in a number of ways and it can be divided, while not strictly, into the following categories:

CUSTOMER SERVICE
As a customer, we use your personal information to fulfill any orders placed through our Site, including processing your payment information and arranging for shipping, as well as sending you related information, including purchase confirmations, invoices, updates, security alerts, recall notices, and product support.  We also use this information to maintain and administer your account.  We may use your personal information to provide you with customer service, to improve upon our service, and to respond to your comments and questions.

STORED DATA
Services we use for data storage, data management, and for marketing/advertising, which may store your data, include:
    Microsoft – OneDrive cloud storage
    Google – Google Drive cloud storage
    WP Engine – Website and databases
    HubSpot – Customer Relationship Management (CRM) platform
    Meta Business Suite – Facebook and Instagram marketing/advertising platform

Data including your personal information which is stored on-site is both by password and physically secured with a full-service monitored alarm system and is backed-up to these storage services listed above.

We securely store and process your information with what is recognized as strong passwords. We most commonly process personal information in the United States, and on occasion in Canada, the Caribbean, and Europe.  We store your information in the cloud which by structural nature may be stored globally, as our cloud data services maintain a global presence and may employ globally redundant backup storage facilities.

MARKETING/ADVERTISING
We use your personal information to augment our analytics, to create and assess our marketing and advertising campaigns, and with our advertising partners and advertising platforms, to improve our Site and online presences, and to personalize and make relevant to you our product offerings and communications.  You may opt out from any of our communications at any time.  If you would like to opt-out from future marketing communications, at the bottom of every marketing email we send is a link you can follow to open your personal marketing preferences page.

SECURITY
As a visitor to our site, your personal information may be used to screen for potential safety concerns, risks, or fraud to protect our business.

CONTESTS
We use your personal information to process and deliver contest or sweepstakes entries and prizes where applicable.

CREDIT CARD INFORMATION
We do not store the credit card information of our retail customers. Your purchase is processed through the industry standard method of using a payment gateway or services such as PayPal and similar, who do not relay or share your credit card numbers with us. We only receive a confirmation that a purchase has been successfully (or unsuccessfully) transacted, after which we fulfill your order.  Funds from your order are transferred to us by the payment gateway.  Our payment gateway is Level 3 PCI-DSS compliant, the most secure.

SHARING YOUR PERSONAL INFORMATION
We may share your Personal Information with our partner companies so that they may offer you their products and services.  You have the right to request that we discontinue sharing your personal information with our partner companies at any time.  We may also share your information with our marketing and advertising partners.  Concerning analytics, we may use analytics services such as HubSpot and Google Analytics to help us understand how our customers use our Site and other presences–you can read more about how Google uses your Personal Information here:  https://www.google.com/intl/en/policies/privacy/.  You can also opt-out of Google Analytics here:  https://tools.google.com/dlpage/gaoptout.

Finally, we may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.

Please note that we do not alter our Site’s data collection and use practices when we see a Do Not Track signal from your browser.

EUROPEAN CUSTOMERS – YOUR RIGHTS
If you are a European resident, you have the right to access your personal information we hold and to request that your personal information be corrected, updated, or deleted. If you would like to exercise this right, please contact us through the contact information below for assistance.  We may charge a fee for this service for the time required to pay for employee task hours.

Additionally, if you are a European resident, please note that we are processing your information to pursue our legitimate business interests listed above.  Please note that your information will be transferred outside of Europe to the United States.

DATA RETENTION
When you provide us with your personal information, we will maintain that information for our records unless and until you ask us to delete it.

CHANGES
We may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.  This privacy policy was last updated on February 6, 2023.
